2. Use of Our Website

2.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our website and services.

2.2 Acceptable Use

You agree not to:

The messaging program consists of general conversational messaging to answer questions and provide support to customers. Messages may also include service updates, appointment reminders, project notifications, billing alerts, and service-related updates. Your consent is voluntary and is not required as a condition of purchasing any goods or services from us.

Required SMS opt-in disclosure: By subscribing to Ovatek Web Solutions text messages, you agree to receive recurring automated informational SMS/MMS messages, including but not limited to service updates, appointment reminders, and service-related updates. 3.2 Cancellation / Opt-Out

You can cancel the SMS service at any time. Just text STOP to the phone number from which you received messages. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. Opting out of SMS does not affect other communications (e.g., email) unless you separately opt out of those.

3.4 Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

3.5 Message & Data Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency will vary based on communication needs. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

3.6 SMS Privacy

We do not sell, rent, lease, or share your mobile phone number or SMS opt-in information with third parties for their promotional purposes. Mobile opt-in data and consent information are never shared with any third party for any purpose. Information collected through our SMS program is subject to our Privacy Policy. 4. Intellectual Property

4.1 Our Content

4.2 Client Work Product

Ownership of work product (websites, designs, content, etc.) created for clients will be governed by the terms of the applicable service agreement. Generally, upon full payment, clients receive ownership of custom deliverables, while Ovatek Web Solutions retains ownership of proprietary tools, frameworks, and pre-existing materials.

4.3 Trademarks

“Ovatek Web Solutions,” our logo, and related marks are trademarks of Ovatek Web Solutions. You may not use our trademarks without our prior written permission.

5. Payment Terms

  • Payment terms, fees, and schedules are outlined in individual service agreements or proposals.
  • Invoices are due upon receipt unless otherwise specified in writing.
  • Late payments may be subject to interest charges and/or suspension of services.
  • All fees are non-refundable unless otherwise stated in the applicable service agreement.

6. Limitation of Liability

To the fullest extent permitted by law:

  • Ovatek Web Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.
  • Our total liability for any claim arising from or related to our services shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.
  • We are not responsible for delays or failures in SMS message delivery caused by your carrier, network issues, or circumstances beyond our control.
  • We are not responsible for any charges or fees imposed by your mobile carrier for SMS messages.

7. Disclaimer of Warranties

Our website and services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

While we strive to deliver exceptional results, we do not guarantee specific outcomes, rankings, traffic levels, or revenue increases from our SEO, AISEO, PPC, or other digital marketing services. Search engine algorithms, AI platforms, and market conditions are outside of our control.

8. Indemnification

You agree to indemnify, defend, and hold harmless Ovatek Web Solutions, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of our website or services, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

We reserve the right to suspend or terminate your access to our website or services at any time, with or without cause, and with or without notice. Upon termination, your right to use our website ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.

10. Governing Law & Dispute Resolution
